Parents independent is a state financial support, which serves the purpose of the cost recovery for the livelihood during a training period. Who gets parent-independent ?

When do I get a parent free ?

How long is a parent-independent available?

The independent is granted for as long as the regular. The duration depends on the respective type of training and is regulated by § 15. In most cases is paid until the end of the training or the standard period of study. The application does not require any special formality. It’s easy via the online form. The Federal Ministry of Education and Research provides all necessary forms.

The completed application must be sent to the responsible training support office. The processing time may take a few weeks. Especially if the application was made at the beginning of the semester, where thousands of applications are received by the Office.

It is important that for students the enrollment certificate is attached to the application. Without this, no processing takes place. Required documents are also required, depending on the proof and the personal circumstances:

Will job, child benefit and housing benefit reduce the benefits?

The maximum rate may be reduced if other sources of income are obtained:

  • Own income
  • Income of the spouse
  • Full orphan’s pension
  • Other income over 450 euros
  • Maintenance or regular gifts of money from, for example, the grandparents
  • Grant from scholarships from 300 euros or other funding institutions
  • Own assets from 7,500 euros

When does the repayment begin?

What are the rates?

As a rule, the parent-independent is paid in quarterly installments. The rate per month is at least 105 euros, so 315 euros every three months.

Which options of payments are there?

Shortly before the end of the five years, the recipient will be informed of the beginning of the repayment obligation. This information is accompanied by repayment options.

According to § 18 para. 5b, the former student has the right to reimburse the debts in a sum or in partial sums to higher amounts.

In the case of a one-time debt repayment, the former recipient benefits from a discount that extends to up to 50 percent of the total debt. However, this is the total debt, because in a complete debt repayment in one time, the 10,000 euro limit falls away, which was granted as the maximum debt. This only applies to installment payments and partial payments.

Calculated this means that under certain circumstances, the amount to be repaid with a one-time replacement is higher, as in the installment and installment. For the latter, a discount of up to 40 percent is offered, depending on the amount and frequency of the installment amounts.

Is the repayment to be avoided?

The reimbursement is to be circumvented by legal means in the case where the debtor does not have sufficient income and assets to make the repayments. The Federal Office of Administration may then still obtain a judicial debtor title, which remains valid for 30 years.

In most cases, the Federal Office of Administration adjusts the claim to repayment if the debtor sets out his insolvency. In addition, a prerequisite for the termination of the repayment obligation is a foreseeability that the debtor will not be solvent in the future. This is the case, for example, where the debtor has suffered lifelong health consequences following an accident, is unable to work and only receives a small accident pension until the end of his life.

Although bypassing the full amount is normally not possible, a partial remission of up to 20 percent of the repayment amount must be applied for due to particularly good performance. Prerequisites for this are:

  • Studies completed before 1 January 2013
  • As one of the 30 best graduate students graduated
  • Graduation reached at the latest 12 months after the end of the grant

When is there a right to deferment / release of the independent ?

Deferments and exemptions are governed by  18a and allow under certain circumstances, payment interruptions of the installment agreements to make.

The right to deferment and exemption apply to persons who temporarily have a low income or for some other reasons are in financial difficulties. Prerequisite is an income that does not exceed an allowance of 1070 euros. If children or children with disabilities are present, the allowances must be increased by application.

The application for the deferral or an exemption is already possible upon delivery of the determination and repayment notice.
